Many mistake new BAC measuring technology for Breathalyzers because of its previous popularity.

- “Per se” DWI Charge – a DWI offense based on BAC without reference or proof of driving impairment.
Sobriety Testing Definitions
- Walk and Turn – A standardized field sobriety test that is administered by requiring the subject to walk heel-to-toe along a real or imaginary line, then turn and return in the same manner. Certain clues of impairment are looked for by law enforcement.
- One Leg Stand – A standardized field sobriety test that is administered by requiring a subject to stand on one leg and count to 30 by thousands. Certain clues of impairment are looked for by law enforcement.
- Horizontal Gaze Nystagmus (HGN) - An involuntary jerking of the eyeball intensified by alcohol consumption. Test is administered by law enforcement using a stimulus and requires a subject to track the stimulus with their eyes. Certain clues of impairment are looked for by law enforcement.
